DHS Extends and Redesignates Haiti for Temporary Protected Status

Extension and Redesignation Announcement Washington, D.C., June 28, 2024 — Secretary of Homeland Security Alejandro N. Mayorkas has announced an extension and redesignation of Temporary Protected Status (TPS) for Haiti. Effective from August 4, 2024, to February 3, 2026, this decision is a response to the extraordinary and temporary conditions in Haiti, including ongoing violence, insecurity, and limited access to essential services such as healthcare, food, and water. Additionally, Haiti’s susceptibility to natural disasters such as storms, flooding, and earthquakes has exacerbated its humanitarian challenges.

Registration Details for TPS The Federal Register Notice provides details for registering for TPS, either as a new applicant or a current beneficiary under Haiti’s extension and redesignation. Following consultations with interagency partners, Secretary Mayorkas determined that the conditions in Haiti justified an 18-month extension and redesignation, aligning with U.S. national interests.

Eligibility and Application Process This extension will enable approximately 309,000 additional Haitian nationals, or those without nationality who last resided in Haiti, to apply for TPS if they were residing in the United States on or before June 3, 2024, and have maintained continuous residence. Eligible individuals may submit their initial TPS applications from July 1, 2024, through February 3, 2026, and can also apply for Employment Authorization Documents (EADs) and travel authorization.

Ineligibility and Re-registration Requirements Haitians who arrived in the United States after June 3, 2024, are ineligible for TPS and may face removal if they cannot establish a legal basis to stay. Current TPS beneficiaries must re-register during the 60-day period from July 1, 2024, to August 30, 2024, to retain their status and employment authorization through February 3, 2026. The validity of certain existing EADs is automatically extended through August 3, 2025.

Detailed Guidance and Enforcement Policy For detailed eligibility criteria, timelines, and application procedures, current beneficiaries and new applicants should refer to the Federal Register Notice. DHS remains committed to enforcing U.S. immigration laws and policies, particularly regarding irregular migration, which poses significant risks and often leads to tragic outcomes.
